RCI Banque (trade name: Mobilize Financial Services and hereinafter referred to as "RCI"), a limited company with a capital of 100,000,000 euros, with its registered office at 15, rue d'Uzès, 75002 Paris, SIREN 306 523 358 R.C.S. Paris (mail:contact-rcipay@icp.rcibanque.com; Phone: 33 (0) 1 76 88 80 00), VAT identification number: FR 95 306523358, APE code: 6419Z, Orias n° 07023704 (Register of insurance intermediaries available on http://www.orias.fr/), under the direction of Martin Thomas as Chief Executive Officer, operates and provides the service of the Mobilize Payment Services Module (hereinafter “MSP Module”) accessible via the My Renault, My Dacia or My Alpine application, subject to full acceptance of these Terms of Use. The General Terms and Conditions of Use also apply to the use of Gift Codes, the order of Reload Keys with or without the activation of the Plug and Charge («PnC») functionality, and to the subscription of the MOBILIZE CHARGE PASS subscription, within the limits of the stipulations of its Special Conditions below.
RCI is a credit institution organised under French law and authorised by the Autorité de contrôle prudentiel et de resolution (ACPR, 4, Place de Budapest, 75436 Paris Cedex 09): RCI is a subsidiary of the Renault group.
Definitions
The following terms, taken interchangeably in the plural and singular, shall have the following meaning between the Parties:
- My Renault, My Dacia, My Alpine Applications: software created by Renault SAS which can be downloadable on smartphones, to provide access to the electric charging service Mobilize Charge Pass offered by RCI and other services provided by the company Renault (via its applications “My Renault”, “My Dacia”, or “My Alpine”) This software also includes the contents, programs, tools (programming, navigation, etc.), databases, operating systems, documentation and all other elements and services that compose it, updates and new versions that can be made to the software by Renault. This software is subject to specific terms and conditions between Renault and the User;
- Charging key: key allowing the User to access the electric charging service for their vehicle; this service is offered by RCI in partnership with PLUGSURFING GmbH;
- Service contract: the service contract concluded between the Third Party Provider and the User through the MSP Module, concluded independently of the General Conditions of Use;
- Personal data: any information relating to an identified or identifiable natural person (hereinafter referred to as the «data subject»); is deemed to be an «identifiable natural person» a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location, an online identifier, or one or more specific elements specific to its physical, physiological, genetic, psychic, economic, cultural or social identity;
- Username: the email of the User filled in and validated in the User database of the My Renault, My Alpine, or My Dacia Application.
- MSP module: the module integrated into the My Renault, My Alpine, or My Dacia Application to enable access to the Mobilize Charge Pass payment service;
- Plug and Charge (“PnC”): the functionality that allows the User to access the contactless electric charging service on their eligible and compatible RENAULT, DACIA or ALPINE brand vehicles; this service is offered by Renault in partnership with RCI and Plugsurfing;
- Third Party Service Providers: any third party to these Terms of Use offering their electric charging services on the MSP Module with whom the User may be required to conclude a separate service agreement;
- User: natural person accessing the MSP Module for their own use, for strictly personal and non-commercial, not-for-profit, direct or indirect purposes, hereinafter also referred to as “You”;
Generalities
- The electric charging service is accessible via the MSP module of the My Renault, My Alpine, or My Dacia Applications, available on any smart phones.
The User declares and acknowledges:
- It has been provided with the necessary information to allow it to access and use the Mobilize Charge Pass;
- they are of legal age and have full legal capacity to commit under these Terms of Use;
- that the MSP Module is to be strictly used only for personal, non-commercial, not-for-profit, direct or indirect purposes and in no event in relation to any professional activity.
Acceptance
The use of the MSP Module implies the express and unreserved prior acceptance of these General Conditions by the User, by checking the box when registering: «I accept the General Conditions of Use».
Purpose of the MSP Module Terms of Use
These Terms of Use are intended to govern the use of the MSP Module by You, the User.
This MSP Module allows You to view and purchase various services offered by Third-Party Service Providers offering electric vehicle charging services.
These General Terms and Conditions of Use do not govern the relationship between the User and the Third-Party Service Providers.
Documentation
Contract documents are, in order of increasing priority:
- These MSP Module Terms of Use; and where applicable;
- The special conditions for ordering Mobilize Charge Pass Refill Keys, if such a product is ordered by the User, or activation of the PnC functionality, if applicable;
- The special conditions for the use of gift codes, if such a means of payment is activated by the User.
- The special conditions for the subscription of the Mobilize Charge Pass subscription, if such subscription is activated by the User.
In case of discrepancy between the General Conditions of Use and the Special Conditions, the latter shall prevail.
Duration, suspension and termination
These Terms of Use are concluded between the User and RCI for an indefinite period.[VN2]
Creating a User Account to access the MSP module
he My Renault, My Dacia, or My Alpine Applications are accessible on compatible mobile phones equipped with Apple iOS or Android technologies and downloadable from the Apple Store and Google Play Store platforms.
Access to the electric charging service requires the personal identification of the User on the respective My Renault, My Dacia or My Alpine Applications.
The User ID and data are transferred to RCI to authorize the User access and allow them to use the Mobilize Charge Pass on acceptance of the terms.
Access to the electric charging service via the MSP module
Access to the electric charging service via the MSP module requires you to have previously opened an account in the My Renault, My Dacia, or My Alpine Application.
When the User accepts the General Terms and Conditions of Use and accesses the MSP Module, they can then benefit from the electric charging service according to the Service Contract entered into with each Service Provider.
To enable the User to benefit from the services of a third-party Provider selected by the User, RCI collects the User’s personal data and transmits it to the Provider in accordance with the RCI privacy policy.
Obligations of the User
The User is responsible for complying with the Service Agreement concluded with the Third Party Providers, complying with the contractual conditions and the regulations applicable to them.
The User undertakes:
- toprovide complete and accurate information about themselves, including their first name and email address, and any other data required for the creation and use of their account;
- to use the MSP Module exclusively for personal, non-commercial use and not to bdivert the use of the electric charging service for personal, advertising, or product sales purposes;
- not to reproduce, temporarily and/or partially, the MSP Module or its contents by any means and in any form whatsoever;
- not to use software or processes designed to copy their content;
- not to adapt, modify, translate, transcribe, compile, decompile, assemble, disassemble all or part of the MSP Module;
- not to export the MSP Module and its contents, and not to merge it with other computer programs;
- to inform RCI if it has knowledge of an act of piracy and/or illegal or non-contractual use of the MSP Module and/or its content;
- guarantee RCI against any claims of third parties related to its use of the MSP Module and its content, unless these claims result from a fault of RCI;
- not to allow unauthorised access to the MSP Module. Any fraudulent access or maintenance to the latter is prohibited under these terms and may also be punished criminally. The same applies to any obstruction or alteration of the functioning of these systems, or in the event of introduction, deletion or modification of the data contained therein;
- not to disrupt the proper functioning of the MSP Module, and in particular not to introduce viruses or any other technology harmful to the services provided.
Information on the electric charging service
It is up to the User to read and appreciate the information displayed on the MSP Module in order to determine to what extent the offers of the Third Party Providers are adapted to his needs, and whether the User chooses to accept them.
Quality of Intermediary of RCI
When the User wishes to subscribe a service with the Third Party Providers, they enter into a Service Agreement, independent of these General Terms of Use.
RCI is therefore not a party to the Service Agreement. Only the contractual conditions of the Third Party Provider concerned apply to the performance of the Service purchased by the User and they will be viewable before placing the service order.
In the context of using the electric charging service and in the event that the User enters into one or more Service Agreement(s), RCI is therefore only an intermediary that connects the User with the Third Party Providers.
RCI is in no way liable to the User for the proper performance of the obligations resulting from Service Agreements, nor for the information, quotes and services provided by Third Party Providers through the MSP Module
RCI provides after-sales service only with respect to the use of the MSP Module.
Any request relating to a Service Contract is the responsibility of the Third Party Provider, which is fully responsible for it. It will be up to the User to refer to the conditions of the Third Party Provider and to contact him directly for any request relating to the Service Agreement.
Price
The use of the MSP Module is free of charge. RCI may be remunerated by additional fees that may be charged according to the services provided to the User or Third Party Provider, but these fees are not paid when the account is created, only when subscribing to the electric charging service, with a Third Party Provider.
The Service Contract concluded between the User and a Third Party Provider governs the price and the terms of payment of the price to be paid by the User in return for the service provided by the Third Party Provider.
The price of the service provided by this Third Party Provider, the additional costs and the payment formalities, are indicated to the User during the service order process.
The Third Party Service Provider is the User’s sole contact and contractual partner with respect to the service subscribed to it.
In particular, the User may request the reimbursement of a payment only from the Third Party Provider concerned and in accordance with the applicable general terms and conditions of the Service Provider.
Means of payment
In order to facilitate and expedite the integrated purchase of goods and/ or services remotely, the User has the option, from the My Renault, My Dacia or My Alpine Applications, to add one or more payment cards (excluding certain categories such as American Express cards) to their User profile by entering the card details required for registration.
The addition and/or deletion of payment cards is at the discretion of the User, from the personal profile in the My Renault, My Dacia, or My Alpine Application.
The integrated payment service is operated by Worldpay (UK) Limited registered under number 07316500, Worldpay Limited registered under number 03424752 and Worldpay AP LTD registered under number 05593466, three companies incorporated in the Kingdom-Headquartered in Walbrook Builing, 25 Walbrook, London EC4N 8AF (Worldpay Package), RCI’s payment partner.
For the purpose of authentication of the payment card entered by the User, a direct debit authorization of 1 euro is immediately made by Worldpay to the User’s Bank.
Depending on the operating procedures of the User’s bank, a debit/credit transaction may be charged to the User’s account but will in any case be returned to the User.
After verification of the authentication of the payment card, the procedure for registering the payment card in the User’s profile is finalized.
The User also has the right to manage and use the gift cards made available to him in the context of commercial operations in the special conditions of the Gift Codes specified below.
Warranty and Liability
RCI undertakes to use its best efforts so that the User can benefit from a peaceful and continuous, but not uninterrupted, access to the MSP Module and the possibility of contacting the Third Party Providers to benefit from the services.
Total or partial interruptions, due or not to RCI, are indeed possible, for example in case of maintenance of the My Renault, My Dacia, My Alpine Applications and/or the MSP Module, technical problems or due to other events outside of our control.
In addition, RCI reserves the right, at any time and at its discretion, to modify, limit or terminate all or part of the services offered through the MSP Module.
RCI makes no warranties of any kind as to the accuracy or completeness of the data made available by Third Party Service Providers who provide the Services directly, to the fullest extent permitted by applicable law.
RCI makes no warranty whatsoever in relation to the services provided by the Third Party Service Providers, in particular as to the availability, characteristics or quality of these services.
Access and use of the charging service is at the User’s own risk. The User is responsible for taking all appropriate measures to protect his own data and/or software stored on his mobile phone and tablet against any intrusion or violation.
RCI is also not liable to the User for indirect damages or losses, such as loss of income or deterioration of the relationship between the User and third parties.
In accordance with applicable law, RCI shall in any event be exempt from any liability:
- In case of non-compliance by the User with the Terms of Use;
- In case of malfunction of the MSP Module due to a cause, voluntary or involuntary, attributable to the User or a third party or resulting from a malicious act;
- In the event of a malfunction and/or failure of the User’s communication network, whatever the cause;
- In case of direct or indirect damage resulting from the use of the MSP Module during driving;
- In case of downloading by the User, which would be contrary to public order or morality, or in violation of any of the above restrictions;
- in case of force majeure.[VN3]
Personal data
RCI collects, processes and uses your data for the implementation of the contractual relationship in accordance with the provisions of the General Data Protection Regulation (2016/679) and other applicable national data protection legislation.
Information relating to the processing of your personal data by RCI is developed in RCI’s privacy policy :
The conditions relating to geolocation devices are specified in the privacy policy on the My Renault, My Dacia, or My Alpine Applications.
Intellectual Property
No assignment
These General Conditions of Use do not imply any transfer of any kind of property rights, including intellectual, on the elements belonging to RCI for the benefit of the User who is prohibited in any event any act and any act likely to directly or not infringe the intellectual property rights of RCI.
In this regard, it is specified that the content of the MSP Module, the general structure as well as the trademarks, drawings, models, animated or not images, texts, photographs, logos, graphic charts, software and programs, search engines, databases, sounds, videos, domain names, design and all other components of the MSP Module, or any other information contained therein, without this list being exhaustive, are the exclusive property of RCI or the partners or third parties who have granted it a license, and are protected by intellectual property rights that are or will be recognized under the laws in force.
Any reproduction and/or representation, in whole or in part, of any of these elements, without the express authorization of RCI, is prohibited and constitutes in particular but not exclusively an infringement sanctioned by the provisions of the Code of Intellectual Property.
User license
RCI grants the User a personal, non-transferableand non-exclusive license to use, in accordance with its purpose, for its own purposes and for the period closest to the following periods: User account opening time or MSP Module commissioning time.
This license grant applies only to the MSP Module, excluding Services provided by other providers or by the payment service provider where applicable.
RCI guarantees the User that it has the necessary rights to grant the right to use the MSP Module.
RCI will bear all damages-interests to which the User could be condemned by a court decision that has become final and whose exclusive basis is the demonstration of an infringement that the User would be accused of in the context of the use of the Platform.
This commitment is subject to the following express conditions:
- That the User has promptly notified, in writing, the infringement action or the declaration that preceded it;
- That RCI was able to ensure the defence of its own interests and those of the User and, to this end, that the User cooperated loyally in the said defence by providing all the elements, information and assistance necessary to carry out such a defence.
The foregoing sets out the limits of RCI’s liability for infringement, patent and copyright arising from the use of hosted computer applications.
Moreover, all elements that would not be protected by an intellectual property right are confidential and are part of RCI’s manufacturing secrets and know-how.
Method and know-how
RCI will retain full and exclusive ownership of its own methods, know-how and tools used to perform these contractual stipulations.
Unsubscription of the User
The User may, at his discretion, delete his account, at any time and without notice, without charge and without cause, by sending an to contact-rcipay@icp.rcibanque.com.
For this purpose, the User may use the Cancellation Form Template attached. It is not mandatory to use this form.
The deletion of the account by the User or RCI entails the termination of the General Conditions of Use.
After termination, the User is no longer authorized to use the MSP Module. The termination of the Terms of Use also automatically terminates all current subscriptions, and results in the deactivation of all Recharge Keys and Gift Codes associated with this account.
Account suspension by RCI
RCI may suspend a User’s account after notifying the User by email:
- If the User has provided incorrect information; or
- If a communication using the contact information contained in the User’s account has failed (for example, outdated email address); or
- In the event of a breach of an obligation under the Terms of Use, unless such breach is not attributable to the User or is only involuntary; or
- If there are legitimate reasons to believe that the User has not complied or will not comply with these Terms of Use.
The reinstatement of the account may occur following an exchange between RCI and the User, having made it possible to rectify or restore the situation that gave rise to the suspension. Failing this, and after a period determined by RCI, the account may be terminated.
Termination by RCI
Termination for convenience of RCI
RCI may, at its discretion, delete the User’s account at any time within a period of two (2) weeks' notice, without cause and without compensation for the User, without legal formalities and by email sent to the User to the email address indicated in his account.
Termination for fault
RCI may also delete the User’s account, at any time and without notice in the event of a breach by the User of any of its contractual obligations under the General Conditions, without compensation to the User, without legal formalities and without prior notice, solely because of the non-performance of the General Conditions of Use.
This decision will be notified by email sent to the User at the email address indicated in his account, without prejudice to other penalties for non-performance.
Safeguard clause
The Terms of Use do not exclude or limit any of the User’s mandatory rights in the User’s country of residence, which cannot be waived by law.
If a provision of the Terms of Use is deemed invalid, the other provisions will not be affected and the invalid provision will be replaced by a valid provision that is as close as possible to the result and purpose of the Terms of Use.
If certain parts of the Terms of Use are not relevant to the User’s use of the MSP Module, this shall not affect the validity or enforceability of any other provision of the Terms of Use.
The provisions of the General Terms of Use intended to remain in force after termination remain valid after such termination.
Non-renunciation
The fact that one of the parties is late in the exercise of any of its rights, or not to exercise them, will not be considered a waiver of the exercise of its rights, whether in relation to a past or future fact.
Force majeure
RCI’s performance of its obligations under the Terms of Use will be suspended in the event of the occurrence of a fortuitous event or force majeure that would hinder or delay its performance.
Are expressly considered as cases of force majeure, in addition to those usually retained by the applicable national jurisprudence, governmental and legal restrictions and modifications, computer failures and telecommunication blocks as well as server failures.
Entire agreement
The Terms of Use constitute the entire agreement between RCI and the User with respect to their subject matter.
The General Terms of Use supersede and supersede any prior stipulations relating to the same subject matter, regardless of its origin.
Languages
The Terms of Use are initially written in French.
If the General Conditions of Use come to be translated into a foreign language, the French language will prevail over any other translation in case of dispute, dispute, difficulty of interpretation or execution of these, and more generally concerning the relations existing between RCI and the User.
Changes to the Terms of Use
RCI reserves the right, at any time, to modify the Terms of Use, taking into account the evolving nature of the MSP Module.
The modified General Conditions of Use are communicated by email to the User in text format with a notification period of at least two (2) weeks before their entry into force.
These modified Terms of Use shall be deemed to be accepted by the User if, at the end of the notification period, the User has not disputed them in writing or continues to use the MSP Module. Any objection by the User is considered as a request to deactivate his account without notice and therefore as a termination of these Terms of Use.
Applicable Law
These Terms of Use and all rights and obligations arising out of or in connection with the use of the MSP Module are governed by and construed and applied in accordance with French law subject to all public policy rules or police laws applicable in the State in which the dispute is before the courts.
Amicable settlement of the dispute
Any dispute relating to the access and use of the account and the MSP Module must be the subject of an amicable settlement between the parties.
In the event of a complaint relating to the use of the account, and the MSP Module, the User may contact RCI by e-mail at the following address: contact-rcipay@icp.rcibanque.com
In accordance with Article L. 612-1 of the French Consumer Code, the User may appeal within one year from the date of his written complaint to RCI to a consumer mediator for the amicable resolution of any contractual dispute between him and RCI under these Terms of Use.
To this end, RCI guarantees to the User acting as a consumer the effective use of a consumer mediation device, for any dispute exclusively related to the use of the account, and the MSP Module.
The user must contact the relevant third-party Service Provider directly, in accordance with the applicable general conditions of the Service Provider, for any request for reimbursement of a payment, and any dispute related to the proper performance of the obligations resulting from Service Contracts, information, quotes and services provided by the Providers through the MSP Module.
The User may consult the European Online Dispute Resolution Platform (OS Platform) available at http://ec.europa.eu/consumers/odr/ or the website of the Consumer Mediation Commission available at https://www.economie.gouv.fr/mediation-conso.
The competent mediator for disputes between the User and RCI in the context of the ICP Module is the FBF mediator.
The mediator will not be obliged to examine the dispute if the request is manifestly unfounded or abusive; if the dispute has been previously examined or is under consideration by another mediator or court. The Consumer User is informed that this mediation procedure does not apply to complaints made to RCI Customer Service, in accordance with Article L611-3 of the French Consumer Code.
Competent court
In the event of a dispute arising from the interpretation or execution of these General Terms and Conditions, the competent court will be determined in accordance with the provisions of common law governing relations between a consumer on the one hand and a professional on the other.

SPECIAL CONDITIONS OF GIFT CODES
1 Subject of the Special Conditions GIFT CODES
These Special Conditions of the Gift Codes are intended to govern the use of the Gift Codes received by the User, and to be activated via the My Renault, My Dacia or My Alpine application (hereinafter, "Gift Code(s)"); they come in addition
- the General Conditions of Use of the MSP Module that precede,
- terms and conditions of My Renault, My Dacia or My Alpine accessible by clicking on the following link (add https://www.renault.fr/mentions-legales.html), and
- PLUGSURFING Partner Terms and Conditions of Sale accessible by clicking on the following link (add https://plugsurfing.com/en/legal/conditions-dutilisation-plugsurfing/).
The User declares to have read the Special Conditions of the Gift Codes before their use. The acceptance or activation of a Gift Code therefore constitutes acceptance without restriction or reservation of these Special Conditions of the Gift Codes.
The Special Conditions of the Gift Codes are applicable for use in countries permitted by the M Renault, My Dacia or My Alpine application.
In addition to these Special Terms, Gift Codes may be subject to additional terms of use associated with a specific offer or promotion.
The Terms and Conditions also apply to these Special Terms.
2 Activation of Gift Codes
In order to use the Gift Code, the User must have an account in the My Renault, My Dacia or My Alpine Application (or create one) and activate his Gift Code from the My Renault, My Dacia or My Alpine Application.
The activation of the Gift Codes also requires the data of a payment card, at the time of its activation, or at any time via the User account, so as to allow additional payment by payment card if the total of the order is greater than the balance of the Gift Code.
Once the Gift Code is activated, the User receives an activation confirmation email and may
- consult the balance of its gift codes and their period of validity
- associate it with a Charge Key for payment of a session of charge of the battery of its electric vehicle within the limit of its value
3 Use of Gift Codes
Gift Codes have a monetary value that can only be used for eligible products and services via My Renault, My Dacia or My Alpine.
The balances of the gift codes, and their validity period, which vary according to the offers, are indicated on the User’s My Renault, My Dacia or My Alpine account.
Depending on the conditions of use specific to the offer or promotion in question, the User may have to activate the Gift Code before a certain date. If the Gift Code is not activated before the specified date, it may expire.
To date, the User may use a Gift Code to:
- Proceed to the payment of a session of charge of the battery of your electric vehicle at the terminals referenced by the partner PLUGSURFING, to the terms and conditions set out in the PLUGSURFING General Terms and Conditions accessible by clicking on the following link (add https://plugsurfing.com/en/legal/conditions-dutilisation-plugsurfing/).
When the User makes a payment with a Gift Code, a ticket specifying payment specifying the amount debited on the gift card is sent to the User until the amount credited on the gift card is exhausted.
If the total of the order is less than the balance of the Gift Code, the User is not refunded the remaining amount on the Gift Code. The balance will remain usable until the expiry date of the gift card. The balance of the Gift Code can only be used in My Renault, My Dacia or My Alpine.
If the total of the order exceeds the balance of the Gift Code, the User will be able to pay for part of the product using the Gift Code and the rest by using another accepted means of payment.
The same Gift Code can be associated simultaneously with several Charging Keys allowing the payment of charging sessions of electric vehicle batteries.
However, several Gift Codes cannot simultaneously be associated with the same Charge Key.
The Gift Code is non-refundable and cannot be redeemed for cash or cash, nor will it be possible to make a cash advance payment for any portion of the balance credited to the Gift Code at the time of purchase.
In case of refund of the User for an order paid with a Gift Code, the Gift Code will be re-credited for the same amount.
The validity periods of the Gift Codes, which vary according to the offers, are indicated on the User’s My Renault, My Dacia or My Alpine account.
After the expiry of the period of validity of a Gift Code, the User may no longer use this Code, nor request a refund of the remaining balance. Therefore, the User must ensure to use the Gift Code before its expiration date.
After the expiration of the Gift Code, the balance of the gift will no longer be valid.
RCI is under no obligation to replace lost or stolen Gift Codes, but the User may report the loss or theft of a Gift Code by contacting the issuer of such Gift Code.
6. RCI’s right to terminate, cancel and refuse a transaction
RCI may terminate these Terms or Special Gift Code Terms, cancel a Gift Code or refuse a transaction if there is reasonable doubt that the relevant Gift Code is being used fraudulently, improperly or illegally, or that the General Conditions or Special Gift Code Conditions have been violated.
SPECIAL CONDITIONS FOR ORDERING ELECTRIC CHARGING KEYS MOBILIZE CHARGE PASS AND/OR ACTIVATING PLUG AND CHARGE FUNCTIONALITY (PnC)
1 Purpose of the Special Conditions MOBILIZE CHARGE PASS
The My Renault, My Dacia or My Alpine Applications allows Users, owners of electric vehicles, to locate charging points, to inquire about their availability, and use charging keys to charge the battery of their electric vehicle with integrated and simplified payment methods.
The purpose of these Special Conditions MOBILIZE CHARGE PASS is to control the order of the Charging Keys by RCI via the MSP Module of the MY Renault, My Dacia or My Alpine Applications, and/or the activation of the PnC functionality and are in addition to:
- the General Conditions of Use of the MSP Module that precede,
- terms and conditions of My Renault, My Dacia or My Alpine accessible by clicking on the following link (add https://www.renault.fr/mentions-legales.html), and
- PLUGSURFING Partner Terms and Conditions of Sale accessible by clicking on the following link (add https://plugsurfing.com/en/legal/conditions-dutilisation-plugsurfing/).
The User declares to have read the Special Conditions MOBILIZE CHARGE PASS before the validation of the order. The validation of the order therefore constitutes acceptance without restriction or reservation of these Special Conditions MOBILIZE CHARGE PASS.
The MOBILIZE CHARGE PASS Special Conditions are applicable for orders made for delivery in countries permitted by the MY Renault, My Dacia or My Alpine application.
The MOBILIZE CHARGE PASS Special Conditions are concluded for the duration necessary to provide the Charging Key, until the expiry of the guarantees and obligations due by RCI.
The Terms and Conditions also apply to these Terms.
2 Ordering a Charging Key
In order to carry out the order, the User follows the following steps:
- go to application MY Renault, My Dacia or My Alpine;
- follow the instructions presented concerning MOBILIZE CHARGE PASS and in particular,
- complete the instructions necessary to open a User account;
- complete the order form;
- validate the order, the price being indicated including taxes;
- follow the instructions of the online payment server to pay the price.
The User then receives an electronic confirmation of acceptance of the order.
RCI undertakes to honor the order only within the limit of available stocks. If there are no charging keys available, RCI informs the User.
However, RCI reserves the right to refuse the order if it does not comply with the General Conditions, passed in bad faith or for any other legitimate reason.
3 Delivery of the order
The Recharge Key is sent to the postal address provided by the User in the purchase process.
The User chooses a delivery address necessarily from the countries offered, under penalty of refusal of the order. The User is solely responsible for a delivery defect due to a lack of indication when ordering.
It is the responsibility of the User to make the reservations and complaints they consider necessary, or even to refuse the package, when the package is clearly damaged on delivery. These reservations and complaints must be sent to the carrier by registered letter with acknowledgement of receipt within three working days, not including holidays, following the date of delivery of the order.
The User must ensure that the Charging Key delivered to him corresponds to the order. In the event of non-compliance with the Charging Key, the User informs RCI by e-mail addressed to contact-rcipay@icp.rcibanque.com
4 Right of withdrawal of a Charging Key order
The User has a right of withdrawal from the sale that can be exercised within a period of fourteen (14) calendar days following the date of receipt of the order.
The User who wishes to exercise their right of withdrawal must inform RCI by email addressed to contact-rcipay@icp.rcibanque.com, before returning the Charging Key within the aforementioned period, in its new condition.
For this purpose, the User may use the Withdrawal Form Template attached. It is not mandatory to use this form.
5.1. Service Activation Procedure
In order to use the electric vehicle charging service, the User must activate their Charging Key from the MY Renault, My Dacia or My Alpine application with the company that operates the service: PLUGSURFING GmbH, a company under German law, registered under number RB 143142B and having its registered office at Weserstr 175. , 12045 Berlin, Germany.
The activation of the service also requires to fill in the data of a payment card, at the time of an order of Key of recharge, at the time of its activation, or at any time via the User account.
5.2. Plug and Charge (PnC) Feature Activation Procedure
If the User has an active charging key and a vehicle of the brand RENAULT, DACIA or ALPINE eligible and compatible with the PnC functionality (description and conditions of use described in the general conditions of use of the application My Renault, My Dacia, or My Alpine), they can choose to activate this feature from the My Renault, My Dacia or My Alpine app.
This activation will allow the User to be automatically identified on compatible charging stations, without having to use their «physical» charging key.
The activation of the PnC feature is free and requires a processing time. The User may follow the progress of their request from the My Renault, My Dacia or My Alpine Application and/or by notification if this feature has been activated beforehand by the User.
The User may deactivate the PnC feature at any time, free of charge, from the My Renault, My Dacia or My Alpine Application.
6 Charging procedure and integrated payment methods
Once the Charging Key and if applicable the PnC feature are activated, the User can charge the battery of their electric vehicle at the charging stations referenced by the PLUGSURFING partner, the terms and conditions set out in the PLUGSURFING General Terms and Conditions of Sale accessible by clicking on the following link (https://plugsurfing.com/en/legal/conditions-dutilisation-plugsurfing/).
It is understood that, given the technological advances made on successive generations of embedded multimedia systems, in the event of any discrepancy between the data relating to charging stations entered in the multimedia screen and those appearing in the My Renault Application, My Dacia or My Alpine, the latter will be those to be considered by the User. Where applicable, the User acknowledges and admits that this possible discrepancy cannot call into question the proper functioning of the multimedia system fitted to their vehicle.
7 Price – Payment Terms
The price of the Charging Key and electric vehicle battery charging sessions, which vary according to the offers, as well as the payment formalities, are indicated during the order process.
In case of electric vehicle battery charging session, without subscription of a Mobilize Charge Pass subscription the amount of each transaction made, is charged to the credit card or gift card associated with the Mobilize Charge Pass. For each electric charging transaction, the User automatically receives, by e-mail, at the address associated with their account My Renault, My Dacia, or My Alpine, a specific invoice.
In case of subscription to a Mobilize Charge Pass subscription offer, under the specific conditions specified below, the User benefits from preferential rates for charging electric vehicles in the networks of partner charging stations.
The payment of the Charging Key and charges are made using the payment card entered in the User account. Otherwise, the User is asked to redirect to their account to fill in and save the data of their payment card.
The User also has the option to use a gift card made available to him in the context of commercial operations, to pay for the loads within the limit of its value and under the special conditions of the Gift Codes specified above.
The User shall immediately inform RCI if they believe that their account or the Charge Key has been used by an unauthorized person or in an unauthorized manner.
In the event of the loss of the Charge Key, the User must immediately inform RCI. If the User does not notify this information to RCI and the Charge Key in question remains used illegitimately, RCI reserves the right to claim from the User the losses incurred as damages, in accordance with the legislation in force. For the sake of clarity, this clause does not constitute an additional claim for damages against the User as a consumer, but only reserves the right to claim damages in accordance with legal law.
RCI will block the Charge Key after receiving notification of its loss or theft and this blocked charge key cannot be reactivated. However, the User may order a new Charging Key via the MY Renault, My Dacia or My Alpine application according to the terms and conditions then in force.
9. Liability
Charging stations that are available through the MyRenault, My Dacia or My Alpine App are operated by charging station operators who are responsible for (i) operating and maintaining their charging stations; and (ii) provide accurate information about their charging stations. RCI cannot guarantee the functionality or availability of charging stations or the accuracy of this information.
SPECIAL SUBSCRIPTION CONDITIONS AL’ ABONNEMENT MOBILIZE CHARGE PASS
1 Purpose of the MOBILIZE CHARGE PASS subscription conditions
The purpose of these Conditions specific to the MOBILIZE CHARGE PASS subscription is to regulate the subscription to electric vehicle charging networks subscribed via the MY Renault, My Dacia or My Alpine application, and come as a complement
- General Conditions of Use of the MSP Module that precede,
- My Renault, My Dacia or My Alpine terms and conditions available by clicking on the following link (add https://www.renault.fr/mentions-legales.html), and
- General conditions of sale of the partner PLUGSURFING accessible by clicking on the following link (add https://www.renault.fr/mentions-legales.html).
The User declares to have read the Conditions specific to the MOBILIZE CHARGE PASS subscription before the validation of the order. The validation of the subscription therefore constitutes acceptance without restriction or reservation of these Conditions specific to the subscription MOBILIZE CHARGE PASS.
The Conditions specific to the MOBILIZE CHARGE PASS subscription apply to the subscription subscribed for the charging of electric vehicle battery in the countries permitted by the MY Renault, My Dacia or My Alpine application.
The Special Conditions for the MOBILIZE CHARGE PASS subscription are concluded for the duration of the subscription, until the expiry of the guarantees and obligations due by RCI.
The Terms and Conditions also apply to these Terms.
2 The Mobilize Charge Pass subscription offer
Subscription to a Mobilize Charge Pass subscription offer: «Mobilize Intense» allows you to benefit from preferential conditions that include access to partner charging networks and preferential prices for electric vehicle charging.
The fare conditions are available on the MY Renault, My Dacia or My Alpine App or by clicking on the following link https://www.renault.fr/mobilize-services/charge-pass.html. They can be modified at any time, subject to prior notice to the User by e-mail at least two (2) weeks before their entry into force.
All applicable prices are valid inclusive of VAT and are indicated during the ordering process before the start of the charging process. Prices can be displayed as a fee per kWh of energy consumed, parking fee for parking time at the charging station, charging session start-up fee and charging time fee
The user acknowledges that the final and payable price of the charging service depends directly on its use, for example on the amount of energy consumed, and is therefore not always provided automatically before the start of the charging process.
3 Subscription terms
The User may subscribe to the MOBILIZE CHARGE PASS subscription via the My Renault, My Dacia or My Alpine application, up to two Charging Keys, according to the following terms:
- User has an active Mobilize Charge Pass Charging Key with or without the enabled PnC functionality
When the User already has an active Mobilize Charge Pass Recharge Key, with or without having activated the PnC functionality of their vehicle, they can subscribe to the Mobilize subscription offer «Intense» by going to the menu «Manage your Charge Pass» / «See Charge Pass subscription offers».
The monthly charge of their subscription is made by means of the payment card which can be, either one of those previously filled in the User profile, or a new payment card. In the absence of a card filled in, the User is asked to redirect to their profile to fill in and save the data of their payment card.
Once the journey has been completed by the User and the subscription has been completed, a confirmation of subscription is sent to the User in the My Renault, My Dacia or My Alpine Application and by email (e-mail address associated with the User’s account)
During the journey, the User has the possibility to order an additional Mobilize Charge Pass Charging Key and/or activate the PnC feature, when their vehicle is equipped with this functionality. He must then enter a delivery address in order to receive their Recharge Key Mobilize Charge Pass and a billing address. Subscription invoices are available in the My Renault, My Dacia or My Alpine App. The User receives, in addition to the confirmation of their subscription, the email confirmation of the order of their Recharge Key Mobilize Charge Pass and/ or the request for activation of the PnC feature.
Enabling the PnC feature requires a processing time. The User may follow the progress of their request from the My Renault, My Dacia or My Alpine Application and/or by notification if this feature has been activated beforehand by the User.
- User has more than two Mobiltze Charge Pass Charging Keys
When the User has more than two Mobilize Charge Pass Recharge Keys, they can subscribe to the subscription offer by going to the menu «Manage your Charge Pass» / «See the Charge Pass subscription offers» and this, only for two Mobilize Charge Pass.
The monthly charge of their subscription is made by means of the payment card which can be, either one of those previously filled in the User profile, or a new payment card. In the absence of a card filled in, the User is asked to redirect to their profile to fill in and save the data of their payment card.
The User must also enter their billing address which will be used on the wording of their subscription invoices. Subscription invoices are available in the My Renault, My Dacia or My Alpine App.
Finally, the User must select the two Mobilize Charge Pass Charging Keys that can benefit from the Mobilize Intense subscription. Unselected Reload Keys will be disabled.
Once the journey has been completed by the User and the subscription has been completed, a confirmation of subscription is sent to the User in the My Renault, My Dacia or My Alpine Application and by email (e-mail address associated with the User’s account)

- The User does not have a Mobilize Charge Pass Charging Key
When the User does not have a Mobilize Charge Pass Charging Key they can subscribe to the Mobilize Intense subscription offer by going to the menu «discover charging on the go/ see offers Charge Pass Mobilize»,
The User is invited to fill in the data of their payment card and accept the General Conditions of Sale of RCI and PLUGSURFING.
The User must provide a mailing address in order to receive the Mobilize Charge Pass Charging Key, if applicable, and a billing address that will be used on the label of their subscription invoices. Subscription invoices are available in the My Renault, My Dacia or My Alpine Applications.
Once the journey has been completed by the User and the subscription has been completed, a confirmation of subscription and order of their Mobilize Charge Pass, is sent to the User in My Renault, My Dacia or My Alpine App and by email.
Then the user may then request the activation of the PnC feature. The User may follow the progress of their request from the My Renault, My Dacia or My Alpine Application and/or by notification if this feature has been activated beforehand by the User.
4. Terms of Use
- Subscriptions are non-transferable and are for personal use only and should only be used by the person who subscribes the subscription ("User"). The User is only allowed to perform one charging session at a time. Concurrent charging sessions are not allowed. Misuse of the subscription constitutes a violation of these subscription terms and conditions of use.
- It is the responsibility of the User to ensure that the payment card registered on their User account is valid, and that it has not been blocked. In the event that the debit of the payment card was not possible, RCI reserves the right to temporarily suspend access to the electric vehicle charging service until full payment of the balance of the indus.
- Charging stations that are available through the My Renault, My Dacia or My Alpine Application are operated by charging station operators who are responsible for (i) operating and maintaining their charging stations; and (ii) provide accurate information about their charging stations. RCI cannot guarantee the functionality or availability of charging stations or the accuracy of this information.
- RCI reserves the right to refuse subscription to a Mobilize Intense subscription if it does not comply with these General Conditions or the general conditions of its partners, and in particular those of MyRenault, My Dacia or My Alpine Applications or Plugsurfing, or if it was made in bad faith or for any other legitimate reason.
5 Right of withdrawal
The User has a right of withdrawal of their Mobilize Intense subscription that can be exercised within fourteen (14) calendar days of subscription.
The User who wishes to exercise their right of withdrawal relating to their Mobilize Charge Pass subscription can exercise it via the functionality available on the My Renault, My Dacia or My Alpine Applications.
In the latter case, the User may use the Withdrawal Form Template attached. It is not mandatory to use this form.
6 Duration of subscription, termination
- Duration
The subscription is subscribed for an initial period of 1 month from the date of confirmation of the subscription, renewed by tacit renewal for the same period. The date of validity of the subscription is indicated on the User’s account on the Application My Renault, My Dacia, My Alpine.
- Termination by RCI
RCI may terminate these General Terms or Special Subscription Terms for the Mobilize Intense subscription, cancel a subscription or refuse a transaction if we suspect that the relevant subscription is being used fraudulently, improperly or illegally, or if we have reason to assume that the MOBILIZE CHARGE PASS Subscription Terms and Conditions have been violated.
- Termination by the User
You can cancel your Mobilize «Intense» subscription at any time and you will continue to have access to the service until the end of the current monthly period. Payments are non-refundable and we do not grant any refunds or credits for periods of partial use.
To cancel your Mobilize «Intense» subscription, you can use the cancellation feature available in the My Renault, My Dacia or My Alpine application by going to the menu «Manage your Charge Pass» / «Detail of your offer», then follow the instructions.
