RCI Banque (trading name: RCI Bank and Services, hereinafter referred to as “RCI”), a société anonyme (corporation) with a registered capital of 100,000,000 euros, having its registered offices at 15 rue d'Uzès, 75002 Paris, France, Business identification (SIREN) No. 306 523 358 R.C.S. Paris (e-mail: support@rcipay.freshdesk.com); Telephone: 33 (0) 1 76 88 80 00), VAT identification No.: FR 95 306523358, Business sector (APE) code: 6419Z, Orias No. 07023704 (Register of insurance intermediaries, that may be consulted at http://www.orias.fr/), having as its publication director Joao Miguel Dos Santos Leandro, Chief Executive of RCI BANQUE (legal representative of RCI BANQUE), operates and provides the service of the RCI Pay Application and the IN CAR PAYMENT Module accessible via the My Renault application, subject to full acceptance of these General Terms and Conditions of Use. The General Terms and Conditions of Use also apply to the order of Charging Keys, within the limits of the provisions of the Special Terms and Conditions below.  

 

RCI is a credit institution organised under French law and authorised by the Autorité de contrôle prudentiel et de resolution (the French banking supervisory authority, ACPR, 61 rue Taitbout, 75436 Paris Cedex 09): RCI is a subsidiary of the Renault group. 

 

1. Definitions

 

The terms defined below, irrespective of whether they appear in the singular or in the plural, shall have the following meanings between the parties: 

 

  • RCI Pay Application: software downloadable onto a smartphone which is a contact/intermediation platform published by RCI and which includes the possibility of ordering Charging Keys or accessing a Catalogue of Services offered by Third Party Service Providers; 

 

  • MY Renault Application: software downloadable onto a smartphone which makes it possible to access the RCI Pay application's Service Catalogue and other services provided by Renault that are independent of RCI, via the ICP Module. This software is subject to a separate set of general terms and conditions between Renault and the User; 

 

  • Charging Key: key allowing the User to access the electric charging service for his/her vehicle; this service is offered by RCI via the RCI Pay Application or the ICP Module, in partnership with PLUGSURFING GmbH;  

 

  • Service Agreement: agreement for the provision of services entered into by and between the Third Party Service Provider and the User through the intermediary of the RCI Pay Application or the ICP Module, and which is concluded independently of the General Terms and Conditions of Use; 

 

  • Personal data: any information relating to an identified or identifiable natural person (hereinafter referred to as the “data subject”); an “identifiable natural person” is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person; 

 

  • identifier: e-mail address of the User, specified and validated in the User database of the RCI Pay Application; 

 

  • ICP Module: module integrated into the My Renault Application making it possible to access the ICP Service Catalogue; 

 

  • Password: the password makes it possible to secure the User's access to the RCI Pay Application. It is temporary then personalised by the User on their first connection. It must be renewed every 12 months; 

 

  • User: natural person accessing the RCI Pay Application for his or her own use, strictly for personal, non-commercial and not-for-profit purposes, hereinafter also referred to as “You”; 

 

  • Third Party Service Providers: all third parties with respect to these General Terms and Conditions of Use, offering their services in the ICP Service Catalogue via the RCI Pay Application or the ICP Module and with whom the User may enter into a Service Agreement; 

 

  • ICP Service Catalogue: all services listed in appendix 1 “Services accessible via the RCI Pay application” presented through the intermediary of RCI via the RCI Pay Application or the ICP Module and provided directly by the Third Party Service Providers. 

 

2. General provisions

 

The ICP Service Catalogue is accessible via the applications available on mobile phones: 

 

  • the RCI Pay Application, published by RCI; and
  • the MY Renault Application, published by Renault, via the ICP Module. 

This ICP Service Catalogue enables Users to benefit from, inter alia, services to wash their vehicle, reserve parking places, or obtain Charging Keys for electric vehicles. 

 

The User declares, represents and acknowledges:

 

  • having the necessary information to access and use the ICP Service Catalogue; 

 

  • having attained the age of majority and having full legal capacity, enabling him or her to enter into contract for the purpose of these General Terms and Conditions of Use;

 

  • if the User is a consumer, he or she is subject to specific legislation and acknowledges that the rights that he or she benefits from may be undermined or lost in the event that the RCI Pay Application or the ICP Module are used by the User in connection with his or her professional activity, meaning in the event that the ordered services are for purposes which enter into the context of the User's commercial or industrial business, the User's trade or craft, or the User's work as an independent professional. If these services are used in a professional context then all clauses that are beneficial to consumers will be held to be inapplicable, including the clauses concerning jurisdiction, the right to retract (cooling-off period) and the applicable law. Jurisdiction in this case shall be attributed to the Tribunal de Commerce (Commercial Court) of Paris, and the General Terms and Conditions shall be governed by French law, without exception.

 

The User declares and represents having obtained all necessary information as to the use of the RCI Pay Application and the ICP Module, and as to the quantitative and qualitative characteristics of the services offered through them.

 

3. Acceptance

 

Use of the RCI Pay Application or the ICP Module requires the express and unreserved prior acceptance of the General Terms and Conditions by the User, by ticking the box: “I accept the General Terms and Conditions of Use” at the time of registration. 

 

The User may at any time consult them, copy them, store them on his or her mobile phone or directly in the RCI Pay application or via the ICP Module, or on any other medium, or print them on paper in order to retain a copy. 

 

RCI has also provided for their communication to the User on a durable medium, at the time of opening of the account and then on any updating of the General Terms and Conditions of Use. 

 

4. Purpose of the general terms and conditions of use of the RCI Pay Application and ICP Module

 

The purpose of these General Terms and Conditions of Use is to provide a framework for the User's access to and use of the RCI Pay Application or the ICP Module.  

 

These Applications make it possible to display, consult and purchase various services offered by Third Party Service Providers registered in the ICP Service Catalogue.

 

These General Terms and Conditions of Use do not govern relations between the User and the Third Party Service Providers who directly provide the various services, which are the subject of separate Service Agreements that must be accepted by the User at the time of subscribing to these services, as relevant.

 

These General Terms and Conditions of Use also do not govern relations between the User and RENAULT in the use of the MY Renault application.

 

5. Documentation

 

The contractual documents are, in increasing order of priority: 

 

  • these General Terms and Conditions of Use of the RCI Pay Application and of the ICP Module; and, as the case may be; 

 

  • the MOBILIZE CHARGE PASS special terms and conditions, for the sale of Charging Keys if such a service is ordered by the User.

In accordance with the ordinary provisions of the law in the event of contradiction between the General Terms and Conditions of Use and the Special Terms and Conditions, the latter will take precedence over the former.

6. Duration, suspension and termination

 

These General Terms and Conditions of Use are entered into by and between the User and RCI for an indefinite duration.

 

7. Creation of a User Account to access the RCI Pay application or the ICP module: identifier and password

 

Access to the ICP Service Catalogue requires the personal identification of the User.

 

7.1 Access to services via the RCI Pay Application

 

Concerning access via the RCI Pay Application, at the time of the first use of this Application, the User is required to create an account using the registration form.

 

Once the fields have been filled in, the User will be asked by e-mail to confirm the creation of his or her account.

 

On each connection, the User will be asked to log in using his or her e-mail address (identifier) and password that he or she chose at the time of the first connection.

 

RCI reserves the right to refuse to open an account for access to this Application by any User if it has legitimate grounds to do so.

 

 

7.2 Access to the Services via the module ICP

 

Access to the ICP Service Catalogue via the ICP module requires an account to have been opened first in the My Renault Application. Once the User has an account in this Application, it is not necessary to create a separate account to access the ICP Module. 

 

The User's identifier and data are transmitted to RCI to authorise access by the User and enable him or her to use the ICP Module, once the User has accepted the present terms and conditions. 

 

7.3. Password and identifier

 

The User is solely responsible for the preservation and confidentiality of the User's identifiers and Password which are strictly personal to the User, and undertakes to take all necessary steps to ensure their complete confidentiality, including changing them as a minimum whenever he or she is automatically asked to do so by the RCI Pay Application.

 

Any use of the password shall be presumed to be done in the name of the User.

The User undertakes to change his or her password without delay in the event that it is disclosed to a third party, voluntarily or not, or in the event the password is lost or forgotten. 

The User shall be solely liable for any use made of his or her Password until such time that he or she requests a change of password under the aforementioned conditions.

No claim may be made seeking RCI's liability in the event of fraudulent use or misuse or due to any voluntary or involuntary disclosure of his or her identifiers and/or Passwords to any other person.

The User guarantees and warrants that the information provided for the purposes of his or her registration is exact.

8. Registration with Third Party Service Providers present in the ICP Service Catalogue

 

Once the User accepts the General Terms and Conditions of Use and registers in the RCI Pay application or accesses it via the ICP Module, he or she may then benefit from the ICP Service Catalogue according to the Service Agreement that he or she enters into with each Service Provider. 

 

To enable the User to benefit from services from a Third Party Service Provider selected by the User, RCI collects the User's personal data and transmits them to the Service Provider in accordance with RCI's privacy policy.

9. Obligations of the User

 

The User is responsible for compliance with the Service Agreement entered into with the Third Party Service Providers, and compliance with the contractual conditions and any regulatory provisions applicable to them.

 

The User undertakes:

 

  • to provide information concerning him or her that is complete and accurate, including his or her first name and e-mail address, and all other data required for the creation and use of his or her account;

 

  • to use the RCI Pay Application or the ICP Module exclusively for personal and non-commercial purposes; not to misuse or exploit the ICP Service Catalogue for personal gain, advertising purposes, or for the sale of goods; 

 

  • not to copy, even temporarily and/or partially, the RCI Pay application, the ICP Module or their content by any means and in any form whatsoever;

 

  • not to use any software or process designed to copy their content;

 

  • not to adapt, modify, translate, transcribe, compile, decompile, assemble or disassemble all or part of the RCI Pay Application, or of the ICP Module;

 

  • not to export the RCI Pay application or ICP Module and their content, and not to merge them with other computer programs;

 

  • to inform RCI if he or she becomes aware of any hacking and/or illegal use or non-contractual use of the RCI Pay application, the ICP Module and/or their content;

 

  • to protect RCI and hold it harmless against any third party claims connected with his or her use of the RCI Pay application or the ICP Module and their content, unless such claims arise due to fault on the part of RCI; 

 

  • not to access and/or remain connected, without authorisation, to the RCI Pay Application or the ICP Module, understood as being an automated data processing system. Any fraudulent access or maintained connection to them is prohibited and is subject to penalties under criminal law. The same applies for any hindrance or alteration to the functioning of these systems, or in the event of introduction, deletion or modification of the data contained therein;

 

  • not to disturb the proper functioning of the RCI Pay Application or the ICP Module, and in particular not to introduce any virus or any other technology harmful to the provided services.

 

10. Information on the ICP Service Catalogue

 

It is the User's responsibility to examine and assess the information displayed on the RCI Pay Application or on the ICP Module in order to determine whether the Third Party Service Providers' offers are suited to his or her needs, and whether he or she wishes to accept them.

 

11. RCI's status as intermediary

 

If the User wishes to subscribe to a service with Third Party Service Providers, he or she shall enter into a Service Agreement, independent of these General Terms and Conditions of Use. 

 

RCI is therefore not a party to the Service Agreements. The performance of the service purchased by the User will be governed solely by the contractual terms and conditions of the Service Provider in question, and they will be consultable before ordering a service.

 

In the context of use of the ICP Service Catalogue and in the event that the User enters into one or more Service Agreement(s), RCI is therefore merely an intermediary who puts the User in contact with the Third Party Service Providers.

RCI shall not under any circumstance be liable towards the User for the proper performance of the obligations arising under the Service Agreements, or for any information, quotations and services provided by the Service Providers through the intermediary of the RCI Pay Application or the ICP Module.

 

RCI provides after-sales service solely with respect to the use of the RCI Pay Application and the ICP Module.

Any request or claim concerning a Service Agreement will be within the powers of the Third Party Service Provider which will alone bear responsibility and liability in that respect. It shall be for the User to refer to the Third Party Service Provider's terms and conditions and to contact it directly for any request or claim pertaining to the Service Agreement.

 

12. Price – Payment terms

 

There is no charge for use of the RCI Pay Application or the ICP Module. RCI may receive remuneration via additional charges applied to the User or the Service Provider, depending on the service in question, but these charges are not paid at the time of creation of the account, only on subscription to a service in the ICP Service Catalogue with a Third Party Service Provider. 

 

The Service Agreement entered into by and between the User and a Third Party Service Provider governs the price and the terms for payment of the price to be paid by the User as consideration for the Service provided by the Service Provider. 

 

The price for the service provided by that Third Party Service Provider, additional charges and payment formalities will be presented to the User during the ordering process for the service.

 

The Service Provider is the User's sole contact and contractual partner with respect to the service subscribed by the User. 

 

Therefore, in particular, for any payment that is made, the User may only demand a refund from the Third Party Service Provider in question and in accordance with the applicable terms and conditions of that Service Provider.

 

Transactions are made using World Pay, a payment services provider that is a business cooperation partner of RCI.

 

13. Warranty and Liability

 

RCI undertakes to make its best efforts so that the User may benefit from peaceable and continuous, but not uninterrupted, access to the RCI Pay Application and the ICP Module and the possibility of making contact with the Third Party Service Providers to benefit from services. 

 

Indeed, complete or partial interruptions are possible whether due to RCI or not, such as in the event of maintenance of the RCI Pay Application and the My Renault Application and the ICP Module or in the event of a technical problem. 

 

In addition, RCI reserves the right to modify, limit or bring an end to all or part of the services that are part of its ICP Service Catalogue, the RCI Pay Application or the ICP Module.  

 

RCI, to the fullest extent permissible under applicable law, does not grant any warranty whatsoever as to the accuracy or completeness of the data made available by the Third Party Service Providers who directly provide the services.

 

RCI does not grant any warranty whatsoever with respect to the services provided by the Service Providers, including in particular as to the availability, the features or the quality of these services.

 

Access to and use of the services appearing in the ICP Service Catalogue shall be at the User's own risk. The User is responsible for taking all appropriate measures to protect his or her own data and/or software stored on his or her mobile phone and tablet against any intrusion or breach.

 

Furthermore, RCI shall not be liable towards the User for any indirect loss or damage, such as loss of income or injury to relations between the User and third parties.

 

In accordance with applicable law, RCI shall in any event be exonerated from any liability: 

 

  • in the event of failure to comply with the General Terms and Conditions of Use by the User;
  • in the event of malfunction of the RCI Pay application or the ICP Module due to any cause, whether voluntary or involuntary, attributable to the User or a third party or resulting from a deliberately harmful act;
  • in the event of dysfunction and/or failure of the User's communication network, whatever the cause;
  • in the event of direct or indirect loss or damage arising from use of the RCI Pay application or the ICP Module while driving;
  • in the event of any upload or download by the User that is contrary to public order or common decency, or in breach of any one of the above restrictions;
  • in the event of force majeure.

 

14. Personal Data

 

RCI gathers, processes and uses the data concerning you to implement the contractual relationship in accordance with the General Data Protection Regulation (2016/679) and other applicable national data protection laws.

 

Information on the processing of your personal data by RCI is further specified in RCI's privacy policy (hypertext link).

 

The conditions concerning geolocation systems are specified in the aforementioned privacy policy. 

 

15. Intellectual Property

 

15.1 No assignment

 

These General Terms and Conditions of Use do not grant any sort of transfer or assignment to the User of proprietary rights, notably any intellectual property rights, in the elements belonging to RCI. The User undertakes in any event not to act in any manner that may undermine or compromise, directly or indirectly, RCI's intellectual property rights.

 

In this respect, it is specified that the content of the RCI Pay Application, the ICP Module, the general structure and the trademarks, designs, models and patterns, images whether animated or not, text, photographs, logos, graphical charters, software and programs, search engines, databases, sound, videos, domain names, the overall design and all other elements making up the RCI Pay Application or the ICP Module, or any other information appearing therein, this list being without limitation, are the exclusive property of RCI or partners or third parties which have granted it a licence for the same, and are protected by the intellectual property rights that are recognised in its favour, now and in future, in accordance with laws in force.

 

Any reproduction and/or representation of all or part of these elements, without the express authorisation of RCI, is prohibited and shall constitute an act of intellectual property infringement that is penalised under the Intellectual Property Code.

 

15.2 Licence for use

 

RCI grants the User a personal, non-transferrable, non-transmissible and non-exclusive licence for use, in accordance with their intended purposes, for his or her own needs and for the shorter of the following durations: the period during which the user account is open or the period during which the RCI Pay Application or the ICP Module is put into service. 

This licence shall only apply to the RCI Pay Application or the ICP Module, to the exclusion of the Services provided by other service providers or by the payment services provider, as the case may be. 

RCI warrants to the User that it has the necessary rights to grant the right to use the RCI Pay Application and the ICP Module.

RCI shall cover all damages that may be awarded against the User by a court decision that has become definitive and which is exclusively based on the demonstration of intellectual property infringement of which the User is accused in the use of the Platform.

This commitment is subject to the following express conditions:

  • the User has promptly given notice, in writing, of the infringement proceedings or the declaration having preceded such proceedings;
  • RCI has been given the possibility of defending its own interests and those of the User and, to do so, the User has faithfully collaborated in such defence by providing all elements, information and assistance required to ensure the proper conduct of such defence.

The foregoing provisions determine the limits of RCI's liability in matters of patent or copyright infringement due to the use of the hosted computer applications.

In addition, all elements that are not protected by intellectual property rights are confidential and form part of RCI's manufacturing secrets and know-how.

16. Method and know-how

 

RCI shall retain complete and exclusive ownership of the methods, know-how and tools that are specific to it and used to perform these contractual provisions.

 

17. Unsubscribing / Deregistration

 

The User may at his or her discretion delete his or her account, at any time and without any period of prior notice being required, without charge and without any stated reason, by e-mail sent to support@rcipay.freshdesk.com

 

The deletion of the account by the User or by RCI shall cause the termination of the General Terms and Conditions of Use. 

 

After termination, the User shall no longer be authorised to use the RCI Pay Application or the ICP Module. The termination of the General Terms and Conditions of Use shall also automatically bring an end to all outstanding subscriptions, and where relevant the deactivation of all Charging Keys associated with this account. 

 

18. Suspension of the account by RCI

 

RCI may suspend a User's account, after notifying him or her by e-mail:

 

  • if the User has provided erroneous information; or
  • if a communication via the contact information appearing in the User's account has failed (e.g. obsolete e-mail address); or
  • in the event of breach of an obligation under these General Terms and Conditions of Use, unless the breach is not attributable to the User or is only involuntary; or
  • if there are legitimate reasons to believe that the User has not complied or will not comply with these General Terms and Conditions of Use.

 

The account may be reinstated following exchanges between RCI and the User which enable the rectification or re-establishment of the situation which caused the suspension. That failing, and after a period determined by RCI, the account may be terminated. 

  

19. Termination

 

19.1 Termination at RCI's discretion

 

RCI may at its discretion delete the User's account, at any time, subject to a prior notice period of two (2) weeks, without needing to give any grounds, without compensation for the User and without any judicial formality being required, by e-mail sent to the User at the e-mail address stated in his or her account.

 

19.2 Termination for breach

 

RCI may also delete the User's account at any time and without notice in the event of breach by the User of any of his or her contractual obligations under the General Terms and Conditions, without compensation for the User, without any judicial formality being required and without prior notice of breach, on the sole basis of failure to perform the General Terms and Conditions of Use. 

 

This decision shall be notified by e-mail to the User at the e-mail address stated in his or her account, without prejudice to any other sanctions that may apply due to breach.

 

20. Safeguard clause

 

The General Terms and Conditions of Use do not exclude or limit any of the User's mandatory rights in the country of residence which, by law, cannot be waived. 

 

If any provision of the General Terms and Conditions of Use is held to be invalid, the other provisions shall not be affected and the invalid provision shall be replaced by a valid provision which comes as close as possible to the result and aim of the General Terms and Conditions of Use. 

 

If certain parts of the General Terms and Conditions of Use are not relevant for the use of the RCI Pay Application or of the ICP Module by the User, this shall not affect the validity or enforceability of any other provision of General Terms and Conditions of Use. 

 

The provisions of the General Terms and Conditions of Use that are intended to remain in force after their termination shall remain valid after such termination.

 

21. No waiver

 

The fact that one of the parties delays in the exercise of any one of their rights, or does not exercise them, shall not be deemed a waiver of the right to exercise those rights, whether with respect to any past or future event.

 

22. Force Majeure


RCI's performance of its obligations under the General Terms and Conditions of Use shall be suspended in case of unforeseen circumstances or the occurrence of an event of force majeure which hinders or delays their performance.

 

The following are expressly deemed to be events of force majeure, in addition to those commonly upheld by applicable national case-law: governmental and statutory restrictions and amendments, computer breakdowns and blocked telecommunications, as well as server outage.

 

23. Entire agreement

 

The General Terms and Conditions of Use constitute the entire agreement between RCI and the User concerning their subject-matter. 

 

The General Terms and Conditions of Use cancel and replace all prior provisions concerning the same subject-matter, irrespective of their origin. 

 

24. Languages

 

The General Terms and Conditions of Use are originally drafted in French.

 

If the General Terms and Conditions of Use are translated into a foreign language, the French language shall prevail over any other language in the event of contradiction, dispute, difficulty in their interpretation or performance, and generally concerning any relations that may exist between RCI and the User.

 

25. Amendment of the General Terms and Conditions of Use

 

RCI reserves the right to amend these General Terms and Conditions of Use, at any time and without notice, considering the evolving nature of the RCI Pay Application or the ICP Module. RCI may in particular, but without limitation, adapt them to any changes in the content or functionalities of the RCI Pay Application. 

 

The amended General Terms and Conditions of Use shall be communicated by e-mail to the User in text format with a prior notice period of at least two (2) weeks before their entry into force. 

 

These amended General Terms and Conditions of Use shall be deemed to be accepted by the User if, on expiry of the notice period, the User has not contested them in writing or continues to use the RCI Pay Application, the ICP Module and/or his or her account. Any contestation by the User shall be deemed to be a deactivation of his or her account without notice, and consequently as the termination of these General Terms and Conditions of Use.

 

26. Applicable law

 

These General Terms and Conditions of Use and all rights and obligations generated by the use of the RCI Pay Application and/or ICP Module or relating thereto shall be governed by French law and shall be construed and applied in accordance with French law, subject however to any public policy or mandatory laws that apply in the country in which court proceedings are brought to settle the dispute.

 

 27. Amicable resolution of disputes

 

Any dispute concerning access to and use of the account and of the RCI Pay Application must be the subject of attempted amicable resolution between the parties.

 

In the event of complaint concerning use of the account, and the RCI Pay application, the User may contact RCI via the RCI Pay Application's support function or by e-mail to support@rcipay.freshdesk.com

 

In accordance with article L. 612-1 of the French Consumer Code, the User may, within a period of one year as of the date of his or her written complaint to RCI, call on a consumer mediator to seek the amicable resolution of any contractual dispute with RCI under these General Terms and Conditions of Use. 

 

For this purpose, RCI guarantees to the User, acting as consumer, effective recourse to a consumer mediation arrangement. 

 

The User may consult the European dispute resolution platform (ODR platform) accessible at the following address http://ec.europa.eu/consumers/odr/ or the website of the French consumer mediation commission (commission d'évaluation et de contrôle de la médiation de la consommation) available at the following address https://www.economie.gouv.fr/mediation-conso.

 

The competent mediator for disputes between the User and RCI in the framework of the RCI Pay Application is the FBF mediator. 

 

The mediator will not be obliged to examine the dispute if the claim is patently unfounded or an abuse of process; if the dispute was previously examined or is in the process of being examined by another mediator or by a court of law. The User (acting as consumer) is informed that this procedure does not apply for complaints made to RCI's Customer Service department, in accordance with article L611-3 of the Consumer Code.

28. Jurisdiction

 

In the event of dispute in the interpretation or performance of these General Terms and Conditions, the competent court shall be determined having regard to the ordinary legal provisions governing relations between a consumer on the one hand and a professional on the other hand.

 

29. List of appendices

 30. Special Terms and Conditions of MOBILIZE CHARGE PASS 

 

30.1 Purpose of the MOBILIZE CHARGE PASS Special Terms and Conditions

 

The purpose of these MOBILIZE CHARGE PASS Special Terms and Conditions are to provide a framework for the order of Charging Keys by RCI via the ICP Module, the MY Renault application or via RCI Pay, and will apply in addition to the preceding General Terms and Conditions of Use.

The User declares and represents having examined the MOBILIZE CHARGE PASS Special Terms and Conditions prior to validating the order. The validation of the order will therefore constitute unrestricted and unreserved acceptance of these MOBILIZE CHARGE PASS Special Terms and Conditions. 

The MOBILIZE CHARGE PASS Special Terms and Conditions are applicable for orders made for delivery in the countries permitted by the MY Renault application or RCI Pay. 

The MOBILIZE CHARGE PASS Special Terms and Conditions are entered into for the period required to supply the Charging Key, until extinction of the warranties and obligations owed by RCI.

The General Terms and Conditions shall also apply to these Terms and Conditions. 

 

30.2 Price – Payment terms

The price of the Charging Key, which varies according to the offer, and the payment formalities will be presented during the ordering process.

 

Payment for the Charging Key is made using the credit/debit card specified in the User account.  That failing, the User will be asked to connect to his or her account to specify and register his or her credit/debit card details.

 

30.3 Ordering a Charging Key 

In order to place the order, the User will follow these steps:

  • connect to the MY Renault or RCI Pay application;
  • following the given instructions concerning MOBILIZE CHARGE PASS and in particular, the instructions required to open a User account;
  • fill in the order form;
  • confirm the order, the price being stated inclusive of VAT;
  • follow the instructions given by the online payment server to pay the Price.

The User will then receive e-mail confirmation of acceptance of the order.

RCI undertakes to honour the order only within the limit of available stocks. If no charging keys are available, RCI shall inform the User of this.

However, RCI reserves the right to refuse the order if it does not comply with the General Terms and Conditions, is made in bad faith or for any other legitimate reason.

 

30.4 Delivery of the order

 

The Charging Key is sent to the postal address specified by the User during the order process.

The User must necessarily choose a delivery address that is among the proposed countries, failing which the order will be refused. The User alone shall be liable for failed delivery due to insufficient information being provided on placing the order.

It shall be for the User to make reservations and claims that he or she deems necessary, or to refuse delivery of the package, if the package is clearly damaged on delivery. Such reservations and claims must be made to the carrier by registered letter with return receipt requested within three business days, not including public holidays, following the date of delivery of the order.

 

The User must ensure that the delivered Charging Key corresponds to the order. In the event that the Charging Key does not comply with the order, the User shall inform RCI via the RCI Pay application support or by e-mail sent to support@rcipay.freshdesk.com 


30.5 Right to retract / Cooling-off period

The User has a right to retract from the sale (cooling-off period) which may be exercised within fourteen (14) calendar days following the date of receipt of the order. 

 

A User who wishes to exercise his or her right to retract must inform RCI of this via the RCI Pay application support or by e-mail sent to support@rcipay.freshdesk.com, before returning the Charging Key within the aforementioned period, in brand-new condition.

30.6 Procedure for activation of the service 

 

To use the electric vehicle recharging service, the User must activate his or her Charging Key via the MY Renault or RCI Pay application with the company which operates the service: PLUGSURFING GmbH, a German company registered under No. RB 143142B and having its registered offices at Weserstr 175., 12045 Berlin, Germany.

 

Activation of the service also requires the provision of payment card details, at the time of a Charging Key order, at the time of its activation, or at any time via the User account.

 

Once the Charging Key has been activated, the User may proceed with charging the battery of his or her electric vehicle at charging stations referenced by the partner, PLUGSURFING, under the terms and conditions defined in the PLUGSURFING's general terms and conditions of sale, accessible by clicking the following link (add the hypertext link).

SPECIAL TERMS AND CONDITIONS FOR GIFT CODES

 

 

1 Purpose of the Special Terms and Conditions for Gift Codes

 

The purpose of these Special Terms and Conditions for Gift Codes is to provide a framework for the use of Gift Codes received by the User, that are to be activated via the MyRenault application (hereinafter, “Gift Code(s)”); they will apply in addition to the above General Terms and Conditions of Use.

The User declares and represents having examined the Special Terms and Conditions for Gift Codes prior to their use. The acceptance or activation of a Gift Code will therefore constitute unrestricted and unreserved acceptance of these Special Terms and Conditions for Gift Codes. 

The Special Terms and Conditions for Gift Codes are applicable for their use in the countries permitted by the MY Renault application. 

In addition to these Special Terms and Conditions, the Gift Codes may be subject to additional terms of use associated with a specific promotion or offer.

The General Terms and Conditions shall also apply to these Special Terms and Conditions

 

2 Activation of the Gift Codes 

 

To be able to use the Gift Code, the User must have an account in the My Renault Application (or create one) and proceed with the activation of his or her Gift Code via the MY Renault application.

 

Activation of a Gift Code also requires credit/debit card details to be filled in, at the time of its activation, or at any time via the User account, in order to enable additional payment by credit/debit card if the order total is greater than the available balance of the Gift Code.

 

Once the Gift Code has been activated, the User will receive an e-mail confirming its activation and may

  • consult the available balance of his or her gift codes and their period of validity
  • associate it with a Charging Key for the payment of a charging session for his or her electric vehicle’s battery 

 

3 Use of the Gift Codes 

 

The Gift Codes have a cash value which may only be used for eligible goods and services via MyRenault.

The available balance of gift codes, and their period of validity, which vary depending on offers, are stated in the User’s MyRenault account.

 

Under the specific terms of use of the offer or promotion in question, the User may be required to activate the Gift Code before a given date. If the Gift Code has not been activated by the specified date, it may expire.

 

At the present date, the User may use a Gift Code for the following purpose: 

  • Paying for a charging session for his or her electric vehicle’s battery at charging stations referenced by the partner, PLUGSURFING, under the terms and conditions defined in PLUGSURFING's general terms and conditions of sale, accessible by clicking the following link (add the hypertext link).

 

When the User pays using a Gift Code, he or she will not be refunded any sum remaining under the Gift Code. The remaining balance of the Gift Code can only be used via MyRenault.

 

If the total amount of the order is greater than the remaining balance of the Gift Code, the User may pay part of the price using the Gift Code and the remainder using another acceptable means of payment.

 

One and the same Gift Code may be simultaneously linked to several Charging Keys to pay for electric vehicle battery charging sessions. 

 

However, more than one Gift Code cannot be simultaneously linked to one and the same Charging Key.

 

Gift Codes are non-refundable and cannot be exchanged against their value in cash, nor is it possible to make a cash pre-payment for part of the balance credited to the Gift Code at the time it is purchased.

 

If a User receives a refund for an order that was paid using a Gift Code, the same amount will be credited back to the Gift Code.

 

4. Period of validity

 

The period of validity of the Gift Codes, which will vary depending on offers, are stated in the User’s MyRenault account.

 

Once the period of validity of a Gift Code expires, the User cannot use that Code any longer, and cannot claim a refund of the remaining balance. Consequently, the User must ensure that the Gift Code is used before its expiry date.

 

After expiry of the period of validity of the Gift Code, the balance of the gift will no longer be valid.

 

5. Loss or Theft

 

RCI shall not in any way be required to replace lost or stolen Gift Codes, but the User may notify the loss or theft of a Gift Code by contacting the issuer of the Gift Code.

 

6. RCI’s right to terminate, cancel or refuse a transaction

 

RCI may terminate these General Terms and Conditions or Special Terms and Conditions for Gift Codes, cancel a Gift Code or refuse a transaction if we suspect that the Gift Code in question is being used fraudulently, improperly or illegally, or if we have reason to suppose that the General Terms and Conditions or Special Terms and Conditions for Gift Codes have been infringed.

 


SPECIAL TERMS AND CONDITIONS FOR SUBSCRIPTIONS TO MOBILIZE CHARGE PASS


1 Purpose of the MOBILIZE CHARGE PASS special subscription conditions

The purpose of these Special Conditions for MOBILIZE CHARGE PASS subscriptions is to provide a framework for subscriptions to electric vehicle charging networks taken out via the MY Renault application, and are complementary to 

- The preceding General Terms and Conditions of Use for the Mobilize Pay Services application and ICP Module, 

- the general terms and conditions of My Renault, which can be accessed by clicking on the following link (add https://www.renault.fr/mentions-legales.html), and

- PLUGSURFING's general terms and conditions of sale, which can be accessed by clicking on the following link (add https://www.renault.fr/mentions-legales.html).

The User declares that he/she has read and understood the special terms and conditions for MOBILIZE CHARGE PASS subscriptions before validating the order. Validation of the subscription therefore implies acceptance without restriction or reservation of these MOBILIZE CHARGE PASS Subscription Special Conditions. 

The Special Terms and Conditions for MOBILIZE CHARGE PASS subscriptions apply to subscriptions taken out for the purpose of charging an electric vehicle battery in the countries permitted by the MY Renault application. 

The Special Conditions for MOBILIZE CHARGE PASS subscriptions are concluded for the duration of the subscription, until the extinction of the guarantees and obligations owed by RCI.

The General Conditions also apply to these Conditions. 


2 The Mobilize Charge Pass subscription offer

Subscribing to the Mobilize Charge Pass: "Mobilize Intense" subscription offer enables you to benefit from preferential conditions including access to partner charging station networks and preferential prices for charging electric vehicles.

Pricing conditions are available on the MY Renault Application or by clicking on the following link https://www.renault.fr/mobilize-services/charge-pass.html.

All applicable prices include VAT and are indicated during the order process before the charging process begins. Prices may be displayed as a charge per kWh of energy consumed, a parking charge for the time spent parked at the recharging station, a charge for starting the recharging session and a charge for the recharging time.

The user acknowledges that the final, payable price of the charging service depends directly on its use, for example on the amount of energy consumed, and is therefore not always provided automatically before the charging process begins.

 

3 Subscription terms

The User may purchase a subscription via the My Renault application, up to a limit of two Mobilize Charge Passes, as follows:


A.           The User already has an active Mobilize Charge Pass

If the User already has an active Mobilize Charge Pass, he/she can subscribe to the Mobilize "Intense" subscription offer by going to the "Manage your Charge Passes" / "View Charge Pass subscription offers" menu.

The monthly subscription fee is debited using the payment card, which can be either one of those previously entered in the User profile, or a new payment card. If no card has been entered, the User is invited to redirect to his/her profile to enter and save his/her payment card details.

Once the User has completed the subscription process, a subscription confirmation is sent to the User in My Renault App and by email. 

During the journey, the User can order an additional Mobilize Charge Pass. The User must enter a delivery address to receive the Mobilize Charge Pass, and a billing address. Subscription invoices are available in My Renault App. In addition to receiving confirmation of his subscription, the User also receives confirmation of his Mobilize Charge Pass order by email.

 

B.           The User has more than two Charge Passes

If the User owns more than two Mobilize Charge Passes, he can subscribe to the subscription offer by going to the "Manage your Charge Passes" / "View Charge Pass subscription offers" menu, and only for two Mobilize Charge Passes.

The monthly subscription fee is debited using the payment card, which may be either one of those previously entered in the User profile, or a new payment card. If no card has been entered, the User is invited to redirect to his profile to enter and save his payment card details.

The User must also enter his billing address, which will be used for the wording of his subscription invoices. Subscription invoices are available in My Renault App.

Finally, the User must select the two Mobilize Charge Passes that can benefit from the chosen subscription. Mobilize Charge Passes not selected will be deactivated.

Once the User has completed the journey and subscribed, a subscription confirmation is sent to the User in My Renault App and by email.

 

C.           The User does not have a Mobilize Charge Pass 

If the User does not have a Mobilize Charge Pass, he/she can subscribe to the subscription offer by going to the "discover charging on the move / see Mobilize Charge Pass offers" menu, or order a Mobilize Charge Pass without subscribing.

The User is invited to enter his/her payment card details and accept the RCI and PLUGSURFING General Terms and Conditions of Sale.

The User must enter a postal address in order to receive the Mobilize Charge Pass, and a billing address which will be used for the wording of subscription invoices. Subscription invoices are available in My Renault App.

Once the User has completed their journey and subscribed, a confirmation of their subscription and order for their Mobilize Charge Pass is sent to the User in My Renault App and by email.

 

4. Terms and conditions of use

A.           Subscriptions are non-transferable and are for personal use only and may only be used by the person who takes out the subscription ("User"). The User is authorized to perform only one charging session at a time. Simultaneous charging sessions are not permitted. Misuse of the subscription constitutes a breach of these Subscription Terms and Conditions of Use.

B.           It is the User's responsibility to ensure that the registered payment card is valid, has a sufficient balance and is not blocked. In the event that debit is not possible, RCI reserves the right to temporarily suspend access to the electric vehicle charging service until the outstanding balance has been paid in full. 

C.           Charging stations that are available through the MyRenault Application are operated by charging station operators who are responsible for (i) ensuring the operation and maintenance of their charging stations; and (ii) providing accurate information regarding their charging stations. RCI cannot guarantee the functionality or availability of charging stations or the accuracy of such information. 

D.           RCI reserves the right to refuse a subscription if it does not comply with these General Terms and Conditions or with the General Terms and Conditions of its partners MyRenault and Plugsurfing, or if it is made in bad faith or for any other legitimate reason.

 

5 Right of withdrawal from a Mobilize Charge Pass subscription

Users have the right to cancel their Mobilize Charge Pass subscription within fourteen (14) calendar days of subscription. 

Users wishing to exercise their right to cancel their Mobilize Charge Pass subscription may do so via the function available on the My Renault application, or by sending an e-mail to support@rcipay.freshdesk.com. 

In the latter case, the User may use the attached Model Cancellation Form. It is not mandatory to use this form. 

 

6 Subscription duration, termination 

A.           Duration 

The subscription is taken out for an initial period of 1 month from the date of confirmation of the subscription, renewed by tacit agreement for the same period. The validity date of the subscription is indicated on the User's My Renault account.

 

B.           Termination by RCI 

RCI may terminate these General Conditions or Special Conditions of Subscription to MOBILIZE CHARGE PASS subscriptions, cancel a subscription or refuse a transaction if we suspect that the subscription concerned is being used fraudulently, improperly or illegally, or if we have reason to suspect that the General Conditions or Special Conditions of Subscription to MOBILIZE CHARGE PASS subscriptions have been breached.

 

C.           Termination by the User

You may cancel your Mobilize "Intense" subscription at any time, and you will continue to have access to the service until the end of the current monthly period. Payments are non-refundable and we do not issue refunds or credits for periods of partial use.

To cancel your Mobilize "Intense" subscription, you can use the cancellation feature available in the My Renault application by going to the "Manage your Charge Pass" / "Details of your offer" menu, then follow the instructions.
